809 students through “All India Students Association” moved a letter petition seeking suo moto congnizance of the Hon’ble Supreme Court against the direction of CBSE to conduct the compartment examination.

The said letter petition is filed inter alia on the following grounds-

a. No update on the schedule of compartment examination yet. Most of colleges have given examination deadline.

b. Exposes students/parents/teachers and staff to a lot of risk in view of exponential growth of the virus in the country;

c. Students surrounded by a cloud of uncertainty as to when the exams would be conducted and in which mode it will be conducted;

d. Offline examination is not possible in the pandemic situation. Schools converted into quarantine centres;

e. The decision of the CBSE is against the MHA Unlock III guideline dated 29.07.2020, which provides that the schools, colleges and educational institutions will remain closed.

f. The Minister of Higher Education stated yesterday that yet there is no date fixed for reopening schools and the safety of the students is a primary concern. How can the students be then expected to appear for compartment examination in the current situation.

g. The students are not contending the importance of exams but are seeking appropriate direction of this Hon’ble Court only in this pandemic situation.

  1. Please point out Article 21 ‘Right to Life’ CBSE exposes us in danger of covid and thus they are violating our fundamental right
    I. e. Article 21

  2. I am student from Delhi who got compartment in 12th science in chemistry by 4 marks. Now i wanted to give the exam but once all of this Covid-19 situation went off but not during this period. Because my area became a corona hot spot and no teacher was willing to provide any direct assistance to me and therefore i didn’t got the chance to prepare for my compartment examination.
    So my suggestion to the govt. is to ether postpone the exam or cancel it. Cause if you are saying that cancelling exam can destroy the future of a student then after death by contracting corona through a possible staff member or student can just finish his/her future in seconds.
    I stand with the 809 students who field the petition in SC.
    And i was and am willing to attend the exam but not under these circumstances and until the country, state or city isn’t free from corona
